11th Circ. Revives Paychex FLSA Collective Action

Law360, New York (February 05, 2010, 12:38 PM ET) -- A federal appeals court has overturned a ruling that Paychex Business Solutions Inc. could not be held liable as an employer in a putative collective action claiming that a mortgage company that leased employees from the administrative services provider failed to compensate the workers properly.

In an unpublished opinion issued Thursday, the U.S. Court of Appeals for the Eleventh Circuit vacated a Florida court's decision to grant Paychex summary judgment on the question of whether it counted as the plaintiffs' employer under the Fair Labor Standards...
