5th Circ. Upholds Toss Of Harley-Davidson Defect Suit

Law360, New York (February 05, 2010, 2:41 PM ET) -- A federal appeals court has upheld the dismissal of a woman’s case alleging the motorcycle she bought from Harley-Davidson Motor Co. had a defect that made it hard for her to steer and caused her to crash.

The U.S. Court of Appeals for the Fifth Circuit on Wednesday affirmed a grant of summary judgment to the motorcycle company, holding that the district court did not err by finding the recall notices affecting the model of the plaintiff’s bike inadmissible because they were issued after the accident....
