IFF's Tort Claims Barred In Tainted Vanilla Spat

Law360, New York (February 08, 2010, 7:10 PM ET) -- A federal appeals court has barred an extract producer from treating a products liability claim against a contractual partner as a torts claim, upholding a lower court's decision.

International Flavors & Fragrances Inc. will not be able to bring a products liability claim against a dealer that allegedly sold it mercury-laced vanilla beans because the issue of liability should have been hashed out within the parties' contract, making it a contractual issue, the U.S. Court of Appeals for the Third Circuit said in an opinion Friday....
