Howrey To Remain As BSC Counsel In Stent IP Suit

Law360, New York (February 09, 2010, 4:11 PM ET) -- A district judge has reversed a magistrate judge's order disqualifying Howrey LLP from defending Boston Scientific Corp. in a patent infringement suit brought by Wyeth over drug-eluting stents, holding that the firm's representation of Wyeth in an unrelated case does not create a significant conflict of interest.

While Howrey did violate Rule of Professional Conduct 1.7, which prohibits a lawyer from representing a client in a manner that may adversely affect another client, disqualification is not an automatic punishment, Judge Joel A. Pisano of the U.S....
