Satellite Radio IP Suit Survives Sirius Bid To Dismiss

Law360, New York (February 12, 2010, 12:12 PM EST) -- A federal judge has rejected a request by Sirius XM Radio Inc. and others to dismiss a suit accusing them of infringing two patents related to content distribution by satellite radio service providers, which the defendants argued are invalid.

On Thursday, Judge T. John Ward of the U.S. District Court for the Eastern District of Texas denied the defendants' motion to dismiss Consumer Satellite Radio LLC's suit, calling a ruling on invalidity premature because the court has not yet construed the patent claims in the case....
