Law360, New York (February 12, 2010, 6:42 PM ET) -- If a juror makes statements revealing religious or ethnic prejudice during deliberations, the verdict should be tossed out and a new trial should be held, the Missouri Supreme Court has decided in a rare ruling on juror bias.
In the unanimous ruling handed down Tuesday, the state high court grappled with the so-called Mansfield Rule, which says a juror's claims of jury misconduct affecting deliberations cannot be used to nix a verdict.
