Lowe's Fires 1st Strike In Battle Over Ethernet Patents

Law360, New York (February 16, 2010, 2:59 PM ET) -- Lowe's Cos. Inc. has gone on the offensive against U.S. Ethernet Innovations LLC, the owner of Ethernet technology developed by 3Com Corp., to secure a court ruling that it has not infringed a portfolio of computer networking patents.

Lowe's filed a declaratory judgment suit Friday in the U.S. District Court for the Western District of North Carolina, claiming USEI had threatened the retailer's business by demanding an immediate and “massive” cash payment to license the technology.
