Intervenor Attys Avert Penalty In Saw Blade Duty Row

Law360, New York (February 16, 2010, 1:54 PM ET) -- Counsel for foreign saw blade manufacturers intervening in a duty dispute received a tongue lashing from a judge for relying on “phantoms in the record,” but have escaped sanction after arguing in vain for a stay in the case pending appeal.

Judge R. Kenton Musgrave lacerated counsel for the intervenor defendants Friday in the U.S. Court of International Trade but rejected plaintiff Diamond Sawblades Manufacturers’ Coalition’s bid for sanctions and refrained from otherwise penalizing the intervenors’ attorneys, ultimately deeming their joint motion for a stay reasonable....
