TVA Moves To Trim Residents' Coal-Ash Sludge Suit

Law360, New York (February 16, 2010, 7:31 PM EST) -- The Tennessee Valley Authority has asked a judge to toss an inverse condemnation claim brought by one of 21 plaintiffs who are jointly seeking damages from a December 2008 retention pond burst that unleashed an avalanche of coal-ash sludge.

In the U.S. District Court for the Eastern District of Tennessee on Friday, the TVA moved to dismiss the inverse condemnation claim brought by Kingston, Tenn., resident James Milt Moseley.
