Thyssenkrupp Appeals Illegal Duty Payouts To US Cos.

Law360, New York (February 17, 2010, 3:12 PM ET) -- Seeking to force domestic steel producers to relinquish millions of dollars illegally received from anti-dumping funds, Thyssenkrupp Mexinox SA de CV and its stateside importer have appealed their case to the U.S. Court of Appeals for the Federal Circuit.

On Tuesday, Thyssenkrupp and Mexinox USA Inc. appealed Judge Donald C. Pogue’s final judgment in the U.S. Court of International Trade, which incorporated an earlier ruling barring the plaintiffs from amending their complaint to include claims for unjust enrichment and disgorgement against domestic steel producers.
