Patent Dispute Freezes Cold Sore Treatment Case

Law360, New York (February 18, 2010, 4:47 PM EST) -- A federal judge in Utah has found that NexMed Holdings Inc. might not own one of the patents for cold sore treatments it has been suing rival Beta Technologies Inc. for infringing, throwing the suit at least temporarily into uncertainty.

U.S. District Judge Tena Campbell of the District of Utah on Tuesday directed parties on both sides to file supplemental briefs on whether NexMed holds legal title to U.S. Patent Number 5,133,352.
