9th Circ. Affirms Toss Of Mitsubishi TV Warranty Action

Law360, New York (February 19, 2010, 4:03 PM EST) -- A federal appeals court has ruled Mitsubishi Digital Electronics America Inc. did not breach its warranty in a consumer class action accusing the company of misrepresenting the picture quality of its TVs.

The U.S. Court of Appeals for the Ninth Circuit upheld a lower court's decision to dismiss the case Wednesday, tossing the plaintiff's claims of breach of warranty, fraudulent concealment, unfair competition and unjust enrichment.
