High Court Seeks SG Input On Procrit Whisteblower Suit

Law360, New York (February 22, 2010, 4:02 PM ET) -- The U.S. Supreme Court has asked that the solicitor general weigh in on whether a whistleblower can bring kickback claims against Ortho Biotech Products LP after the alleged scheme was already revealed in a multidistrict litigation.

The court issued an order inviting briefings on behalf of the U.S. government on Monday in the pharmaceutical company’s challenge to an opinion by the U.S. Court of Appeals for the First Circuit, which allowed the case to proceed.
