KV Pharma Shareholder Suit Over Recalls Nixed

Law360, New York (February 23, 2010, 4:22 PM ET) -- A federal judge has dismissed a consolidated securities lawsuit accusing KV Pharmaceutical Co. of making misstatements and omissions amid widespread drug recalls, saying the plaintiffs failed to plead their case with enough particularity for the suit to go forward.

In a decision Monday, Judge Carol E. Jackson of the U.S. District Court for the Eastern District of Missouri also dismissed the other defendants in the proposed class action: former chairman and CEO Marc Hermelin; President and interim CEO David A. Van Vliet; and Rita E. Bleser,...
