NFL Linebacker Sacks Counterclaim In Contract Suit

Law360, New York (February 24, 2010, 3:31 PM ET) -- Chicago Bears linebacker Brian Urlacher has won his bid to toss Dreams Inc.'s unjust enrichment counterclaim in his suit over the sports memorabilia company's allegedly unlawful termination of an exclusive services agreement.

Judge Samuel Der-Yeghiayan of the U.S. District Court for the Northern District of Illinois on Monday ruled that Dreams' counterclaim seeking to recover funds, under the theory of unjust enrichment for services Urlacher had been paid for but had allegedly not performed, could not be brought concurrently with the company's breach of contract counterclaim....
