Cert. Bid Nixed In Jennifer Convertibles OT Suit

Law360, New York (March 2, 2010, 3:56 PM EST) -- A federal judge has shot down a former Jennifer Convertibles Inc. sales representative's bid to certify a putative collective action accusing the furniture retailer of violating state and federal law by denying its employees proper overtime pay.

Judge Susan Illston of the U.S. District Court for the Northern District of California on Friday denied Ayisha Combs' motion to certify a nationwide collective class under the Fair Labor Standards Act, ruling that the class is not appropriate for certification as presently defined.
