Weyerhaeuser Pollutant Suit Sent To State Court

Law360, New York (March 02, 2010, 12:36 PM ET) -- A lawsuit accusing Weyerhaeuser Co. and International Paper Co. of unlawful releases of pollutants from an Alabama industrial plant has been remanded to a state court following a federal judge's finding that the inclusion of three individual defendants precluded the exercise of diversity jurisdiction.

Adopting a magistrate's recommendation, Judge Callie V.S. Granade of the U.S. District Court for the Southern District of Alabama on Friday remanded the case to the Wilcox County Circuit Court.
