Climate Change Considerations Under NEPA

Law360, New York (March 08, 2010, 2:43 PM ET) -- On Feb. 18, 2010, the Council on Environmental Quality (CEQ) — the agency charged with administering the National Environmental Policy Act (NEPA) — issued its Draft NEPA Guidance on Consideration of the Effects of Climate Change and Greenhouse Gas Emissions.

The draft guidance, if finalized, would help resolve continuing debate over the relevance of climate change to NEPA analyses by recommending — and in some cases requiring — consideration of climate change issues by federal agencies poised to take “major actions” under the statute.
