AmEx Loses Bid To Toss Drugstores' Antitrust Suits

Law360, New York (March 4, 2010, 5:17 PM EST) -- A federal judge has refused to toss five consolidated complaints brought by Rite Aid Corp., CVS Pharmacy Inc., Walgreen Co. and two other drugstores alleging that American Express Co. violated federal antitrust laws by imposing anti-competitive rules on merchants.

Judge Nicholas Garaufis of the U.S. District Court for the Eastern District of New York on Wednesday denied AmEx's motion for judgment on the pleadings, rejecting the credit card company's argument that the plaintiffs' antitrust claims are time-barred by the Sherman Act's four-year statue of limitations....
