ITC Ruling Favors Microtune In Patent Dispute With Broadcom

Law360, New York (June 1, 2004, 12:00 AM EDT) -- A judge has rejected chip maker Broadcom's appeal in its U.S. International Trade Commission patent suit against rival Microtune.

Administrative Law Judge Sidney Harris issued his final initial determination that there was no violation of Section 337 and that the Broadcom patent was invalid on numerous grounds, making the issue of infringement irrelevant. However, he found the patent was not unenforceable due to inequitable conduct, according to Microtune.
