BLM Must Issue Final Decision In Drilling Spat: 10th Circ.

Law360, New York (March 4, 2010, 6:37 PM EST) -- A federal appeals court has upheld a lower court's decision to send a dispute between drilling companies and the Potash Association of New Mexico over permits to drill for oil and gas near potash sites back to the Bureau of Land Management for a final decision.

The U.S. Court of Appeals for the Tenth Circuit on Tuesday confirmed that the BLM is the agency with final jurisdiction in a dispute that pits potash miners against oil and gas companies.
