Erectile-Dysfunction Ruling Allowed To Stand

Law360, New York (December 19, 2006, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit has affirmed a summary judgment dismissing a patent attorney's lawsuit against handheld-ultrasound device company Sonosite Inc. because he had improperly amended his patent application.

The appeals court agreed the patent for an erectile-dysfunction device asserted by the attorney's company, Neutrino Development Corp., was invalid - a decision reached first in March by the U.S. District Court for the Southern District of Texas.
