11th Circ. Upholds Dismissal Of Paxil Suicide Case

Law360, New York (March 8, 2010, 2:23 PM EST) -- A federal appeals court has upheld a lower court's ruling clearing SmithKline Beecham Corp. of responsibility for the death of a 33-year-old Georgia man who committed suicide while taking Paxil.

The U.S. Court of Appeals for the Eleventh Circuit on Friday affirmed the U.S. District Court for the Northern District of Georgia's grant of summary judgment to SmithKline in the wrongful death suit based on the state's learned intermediary doctrine.
