Sheriff Deputy Cinches Cert. On Appeal In Wage Suit

Law360, New York (March 8, 2010, 2:03 PM EST) -- A Florida appeals court has overturned a lower court in finding that a former detention deputy suing over unpaid meal periods is in fact able to represent about 1,000 other deputies, regardless of discrepancies among their claims.

On Friday a three-judge panel of Florida’s Second District Court of Appeal held that the trial court erred in refusing to grant class certification to plaintiff Douglas J. Morgan, concluding that the disparities among the proposed class members' claims will affect damages but not class standing.
