Texas Railway Tie Co. Cancer Case Gains New Life

Law360, New York (March 08, 2010, 7:33 PM ET) -- A federal appeals court has revived a suit brought by current and former residents of Somerville, Texas, who claim a railway tie plant owned by Koppers Industries Inc. polluted their community with toxic chemicals that caused high levels of cancer.

The U.S. Court of Appeals for the Fifth Circuit on Friday vacated the dismissal of the case, which also named Burlington Northern Santa Fe Railway Co., Monsanto Co., Dow Chemical Co. and Vulcan Materials Co., and remanded the case back to district court.
