Roche Asks Court To Declare Enzo Patent Invalid

Law360, New York (June 2, 2004, 12:00 AM EDT) -- Roche Diagnostics has asked a U.S. District Court to declare Enzo Biochem’s patent for DNA labeling as invalid, after licensing talks between the two companies broke down.

The lawsuit, filed in the U.S. District Court for the Southern District of New York, seeks declaratory judgment of patent invalidity with respect to Enzo's 4,994,373 patent. The patent covers labeling of polymerase chain reaction (PCR) products, widely used by medical and law enforcement officials.
