Claims Shredded In Wendy's Bad Lettuce Insurance Suit

Law360, New York (March 9, 2010, 2:30 PM EST) -- A federal judge has trimmed the claims in a suit that alleged broker TWIW Insurance Services LLC failed to obtain the proper insurance for Pacific International Vegetable Marketing Inc., which was sued for providing contaminated lettuce to a Wendy's restaurant.

Magistrate Judge Edward Chen issued the ruling Friday in the U.S. District Court for the Northern District of California, tossing the claims of misrepresentation and breach of fiduciary duty that Pacific levied against TWIW. A breach of contract claim remains.
