Kroger Faces IP Suit Over Gas Rewards Programs

Law360, New York (March 11, 2010, 6:05 PM EST) -- Excentus Corp., a company that develops and manages gasoline purchase rewards programs, has accused supermarket chain The Kroger Co. of infringing four of its patents.

The company filed its complaint Tuesday in the U.S. District Court for the Northern District of Texas, seeking enhanced damages and an injunction blocking Kroger from using the patent technology in its fuel rewards programs.

Irving, Texas-based Excentus acquired the four patents — U.S. Patent Numbers 6,321,984; 6,332,128; 6,732,081; and 7,383,204 — from AutoGas in September 2008, the complaint states. AutoGas...
