False Marking Claim Wave Can't Last, Attys Say

Law360, New York (March 23, 2010, 5:05 PM EDT) -- The U.S. Court of Appeals for the Federal Circuit’s decision in The Forest Group Inc. v. Bon Tool Co. has led to an explosion of lawsuits that accuse companies of marking their products with patents that have expired or no longer cover their articles, but some intellectual property experts say the dramatic surge in cases is not likely to last.
