US Asks CIT To Affirm BP Petroleum Import Duties

Law360, New York (March 15, 2010, 1:29 PM EDT) -- In response to a challenge brought by BP Products North America Inc., the U.S. government is urging the U.S. Court of International Trade to uphold the tariff classification of two premium grade gasoline entries.

The federal government lodged its reply memorandum Friday in opposition to BP's July 10 motion for summary judgment and in support of its own cross-motion for summary judgment, arguing that the disputed entries were properly classified as “motor fuel” under the Harmonized Tariff Schedule of the United States.
