Report Tying Pesticide To Cancer Nixed In Dow Case

Law360, New York (March 15, 2010, 3:05 PM ET) -- A federal judge has granted Dow AgroSciences LLC's bid to exclude a pathologist's expert report for a Pennsylvania exterminator who claims the company's Dursban insecticide products gave him Non-Hodgkin's lymphoma.

Judge Nora Barry Fischer's ruling, issued Thursday in the U.S. District Court for the Western District of Pennsylvania, marks a setback for the plaintiffs, Robert T. Pritchard Sr. and his wife Elizabeth, whose toxic tort claims against the Dow Chemical Co. subsidiary were removed to federal court in November 2007.
