Baja Fresh Seeks To Keep Cash In Pepsi Contract Spat

Law360, New York (March 15, 2010, 7:38 PM ET) -- Baja Fresh is asking for summary judgment in PepsiCo Inc.'s suit claiming the fast food chain must repay incentive money it took to serve Pepsi products because it decided to sell Coca-Cola Co. products once its contract expired.

BF Acquisition Holdings LLC, which owns Baja Fresh, asked the U.S. District Court for the Central District of California on Friday to grant summary judgment in the matter to both it and its former parent company, Wendy's International Inc.
