Emcore Infringes Avago Fiber Optics Patent: ITC

Law360, New York (March 16, 2010, 2:56 PM EDT) -- The U.S. International Trade Commission has preliminarily determined that Emcore Corp. has imported optoelectronic devices that infringe one of the patents asserted against it by Avago Technologies Ltd., while clearing the semiconductor company of infringing a second patent.

ITC Administrative Law Judge Theodore Essex handed down his initial determination Friday, ruling that Emcore violated Section 337 of the Tariff Act of 1930 by importing and selling in the U.S. fiber optic components that infringe several claims of Avago's patent, U.S. Patent Number 5,359,447.
