No Class Cert. In Title VII Suit Against Boston Transit

Law360, New York (March 19, 2010, 4:43 PM EDT) -- Black and Hispanic employees of Boston's commuter rail system operator have lost a bid for class certification in a Title VII suit over the company's promotional practices, with a federal judge finding that they failed to meet several certification requirements.

Judge Mark L. Wolf of the U.S. District Court for the District of Massachusetts denied the plaintiffs' motion Wednesday, finding that they failed to establish the commonality, typicality or adequacy required under Rule 23(a).
