FERC Unveils New Civil Penalty Enforcement Guidelines

Law360, New York (March 18, 2010, 6:52 PM EDT) -- The Federal Energy Regulatory Commission adopted new civil penalty guidelines Thursday that it says will increase the fairness, consistency and transparency of its enforcement determinations.

The new guidelines, which are modeled on portions of the U.S. sentencing guidelines with appropriate modifications to account for FERC-specific considerations, base penalty calculations on a set of uniform factors that are weighed similarly for similar types of violations and similar types of violators, according to the commission's policy statement.
