Law360, New York (May 14, 2010, 1:58 PM EDT) -- As the U.S. Department of Labor and the Internal Revenue Service embark on a joint effort to root out misclassification in a range of industries, employers with independent contractors should conduct an internal audit to see whether those individuals truly are their own boss, attorneys say.

Though there are many tests to determine whether an employee is misclassified as an independent contractor, the level of control the employer exerts over how that person does his job will be the big question, attorneys say.
