High Court To Mull FLSA Coverage For Oral Complaints

Law360, New York (March 22, 2010, 6:43 PM EDT) -- The U.S. Supreme Court on Monday agreed to hear a retaliation suit brought by a former Saint-Gobain Performance Plastics Corp. employee, following an appeals court ruling that his verbal complaints weren't protected activity under the Fair Labor Standards Act.

The high court assented to take up Kevin Kasten's case after seven out of 10 judges in the U.S. Court of Appeals for the Seventh Circuit denied his bid for an en banc rehearing in October.
