Retirees Seek To Revive Philips ERISA Class Action

Law360, New York (March 23, 2010, 1:04 PM EDT) -- Former employees of Philips Electronics North America Corp. are appealing the dismissal of a class action accusing the company of violating employee benefits laws by canceling retiree health plans after a subsidiary filed for bankruptcy.

The plaintiffs filed a notice of appeal Monday in the U.S. District Court for the Eastern District of Michigan signaling their intent to challenge Judge Patrick J. Duggan's March 3 decision in favor of Philips.
