Open Source Co. Hits IBM With EU Monopoly Claim

Law360, New York (March 23, 2010, 3:16 PM EDT) -- Paris-based TurboHercules SAS asked European Union antitrust regulators Tuesday to investigate IBM Corp. based on claims that the computer giant uses unfair licensing practices to keep customers from using open source alternatives to IBM's mainframe operating system.

TurboHercules, which promotes and offers commercial support for open source mainframe emulator Hercules, filed its formal complaint with the European Commission, alleging that IBM has used litigation, "preemptive takeovers and threats against would-be competitors" to eliminate competition in the mainframe market.
