Delta Barely Survives Summary Bid In Wi-Fi IP Spat

Law360, New York (March 24, 2010, 3:35 PM EDT) -- A federal judge has decided against granting sua sponte summary judgment against Delta Air Lines Inc. in Ambit Corp.'s suit accusing the airline of infringing a wireless Internet system patent, paving the way for a trial.

District Judge William G. Young of the U.S. District Court for the District of Massachusetts on Tuesday said Delta barely escaped summary judgment against it, a penalty he considered in light of the airline's weak expert testimony in a previous motion.
