FLSA Doesn't Preempt Farmworkers' Contract Claims

Law360, New York (March 25, 2010, 12:07 PM EDT) -- A federal judge has granted class certification to former workers at tomato farming company Candy Brand LLC for their breach of contract claims, disagreeing with Candy Brand that the claims are preempted by the Fair Labor Standards Act.

Judge Harry Barnes of the U.S. District Court for the Western District of Arkansas granted the class certification Tuesday. The court had already conditionally certified the case as an opt-out collective action under the FLSA.
