Class Claims Stay In Mining Co. Sex Harassment Suit

Law360, New York (March 29, 2010, 1:42 PM EDT) -- A federal judge has denied aggregate mining company Fisher Sand & Gravel Co.’s bid to toss class claims from a sexual harassment suit brought by the U.S. Equal Employment Opportunity Commission.

Judge Martha Vazquez of the U.S. District Court for the District of New Mexico on Thursday denied most of the company’s motion to dismiss the class claims from the EEOC’s lawsuit filed on behalf of two former female employees at the company’s Mora, N.M., plant and other unnamed class members.
