Judge Allows Baxter AWP Qui Tam Suit To Proceed

Law360, New York (March 26, 2010, 7:32 PM EDT) -- The federal judge overseeing the average wholesale price litigation has refused to dismiss a qui tam action alleging Baxter International Inc. defrauded Medicare and Medicaid programs by reporting inflated pricing information on certain drugs.

Judge Patti Saris of the U.S. District Court for the District of Massachusetts on Thursday rejected Baxter's bid to toss the action brought under the False Claims Act by relators Linnette Sun and Greg Hamilton.
