Purchasers' Antitrust Suits Over Generic Plavix Tossed

Law360, New York (March 26, 2010, 7:02 PM EDT) -- A federal judge on Friday dismissed three lawsuits brought by direct purchasers of Plavix accusing Bristol-Myers Squibb Co., Sanofi-Aventis and Apotex Corp. of illegally keeping a generic version of the blood thinner from the market.

Judge Michael H. Watson of the U.S. District Court for the Southern District of Ohio concluded that the plaintiffs in the three suits could not prove antitrust injury and lacked standing to bring Walker Process claims to invalidate Sanofi-Aventis' patent for the drug.
