Insurer Avoids $4.6M Claim Over Faulty Del Monte Cans

Law360, New York (March 31, 2010, 3:05 PM EDT) -- Silgan Containers Corp. has lost a bid to force its insurer to pay more than $4.6 million to cover losses stemming from defective pull-tab cans it made for Del Monte Corp., which would have sold the cans as fruit cups.

Judge Phyllis Hamilton of the U.S. District Court for the Northern District of California granted partial summary judgment to the insurer, National Union Fire Insurance Company of Pittsburgh, on Monday. She also denied a similar motion filed by the plaintiff.
