Army Corps Ditch Regulation Valid Under CWA: Court

Law360, New York (April 1, 2010, 1:52 PM EDT) -- A federal judge has ruled that a U.S. Army Corps of Engineers regulation requiring a permit for the discharge of fill materials into nontidal upland ditches does not violate the Clean Water Act, turning back a challenge to the provision by the National Association of Home Builders.
