LA Loses Bid To Put Out Firefighter Trainees' FLSA Suit

Law360, New York (April 5, 2010, 2:31 PM EDT) -- A federal judge has rejected most of Los Angeles' efforts to limit a collective action accusing the city's fire department of violating federal wage-and-hour laws by failing to pay probationary firefighters for work done off the clock, ruling that too many factual disputes remained in the case.

Judge Dale S. Fischer of the U.S. District Court for the Central District of California denied the city's request to decertify the plaintiffs' class in an order issued in chambers Friday.
