Arch Coal Unit Sues EPA Over Mine Permit Veto

Law360, New York (April 5, 2010, 3:58 PM EDT) -- An Arch Coal Inc. unit has sued the U.S. Environmental Protection Agency over its unprecedented proposal to veto a Clean Water Act permit for a West Virginia coal mine, saying it isn't empowered to revoke an already-issued permit.

The unit, Mingo Logan Coal Co., sued the EPA on Friday in the U.S. District Court for the District of Columbia in a bid to thwart the EPA's planned veto of the Section 404(c) permit for its Spruce No. 1 surface mine in Logan County, W.Va.
