Judge Calls Merck Subpoena “Abusive And Arrogant”

Law360, New York (January 8, 2007, 12:00 AM EST) -- Merck & Co. Inc. and its lawyers have been chastised by a judge in the drug maker's dispute with the New England Journal of Medicine in the pending mass-tort litigation over the company’s former blockbuster drug Vioxx.

The harsh words were delivered last month, when Massachusetts Superior Court Judge Thomas E. Connolly granted the Journal’s motion to quash a subpoena that would have compelled a third deposition of one of its executive editors.
