Law360, New York (April 13, 2010, 2:43 PM ET) -- A federal judge has denied summary judgment to both sides in a long-running battle between Sears Petroleum & Transport Corp. and Archer Daniels Midland Co. over patents for roadway de-icers.
Judge David E. Peebles of the U.S. District Court for the Northern District of New York on Friday shot down motions filed by both sides on the issue of invalidity, and an additional bid by the defendants for judgment on the issues of noninfringement and the patents' priority date.
